Information We Collect

We collect information that identifies individuals who sign up to receive testing and/or vaccination services provided by Visit Health. In particular, we have collected the following categories of personal information from consumers within the last twelve (12) months:

Category A- Identifiers

Examples: Name, postal address, email address, phone number

Category B- Personal information categories listed in the California Customer Records Statute (Cal. Civ. Code §1798.80(e)).

Examples: Name, telephone number, insurance policy number, information about symptoms of physical illness (COVID-19)

Category C- Protected class characteristics under California or federal law

Examples: age, race, ethnicity, gender.

Personal information does not include:

  • Publicly available information from government records

  • De-identified or aggregated consumer information

  • Information excluded from CCPA’s scope, including health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA)

How We Collect Information

We obtain the categories of personal information listed above as follows:

  • Directly from our clients or their agents (for example, from information our clients provide to us about expected participants in a testing or vaccination event)

  • Directly from you (for example through the information we request when you register for a testing or vaccination appointment.)

Use of Personal Information

We may use or disclose the personal information we collect for one or more of the following business purposes:

  • To fulfill or meet the reason for which the information is provided. For example, to submit this information to a laboratory that is processing COVID-19 test specimens so that results can be reported to you.

  • To provide you with alerts and other notices concerning our Services, such as appointment reminders and results notifications.

  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations (for example, to comply with government regulations requiring notification to public health departments of all positive COVID-19 test results.)

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

In the preceding twelve (12) months, we have not sold any personal information.

Your Rights

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you

  • Our business purpose for collecting that personal information

  • The categories of third parties with whom we share that personal information

  • The specific pieces of personal information we collected about you (“data portability request”)

Deletion Request Rights

You have the right to request that we delete any of your personal information we collected from you and retained, subject to certain exemptions. Once we receive and confirm your verifiable consumer request, we will delete, and direct our service provides to delete, your personal information from our records, unless an exception applies. This right does not extend to Personal Health Information (PHI) collected by us our third party partners; such PHI is protected according to the Health Insurance Portability and Accountability Act (HIPAA) and is exempt from the CCPA.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our obligations to you.

  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

  3. Debug products to identify and repair errors that impair existing intended functionality.

  4. Comply with a legal obligation, including obligations to report public health information to local and state departments of public health.

  5. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Your Access, Data Portability, and Deletion Rights

To exercise the rights described above, please submit a verifiable consumer request to us by email at CCPA@visithealth.com. Only you or a person registered with the California Secretary of State that you authorize to act on your behalf may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. You may only make 2 such requests within a 12-month period.

The verifiable consumer request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information, and describe your request with sufficient detail that we are able to understand, evaluate, and respond to it. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request.

Response Time

We endeavor to respond to a verifiable consumer request within 45 days of receipt; if we require more time (up to 90 days) we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to the registered email associated with the account.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA we will not deny you use of our services or provide you a different level of quality or services as a consequence of exercising these rights.

We reserve the right to amend this Privacy Notice at our discretion and at any time. The date this Privacy Notice was last updated is identified at the bottom of this page.
